House Bill to Stop Obama’s Regulatory Tyranny Advances
Barack Hussein Obama and his administration use unconstitutional power to regulate everything and everyone. Obama has made it clear throughout his presidency that he refuses to allow his agenda to be derailed by Congress. Obama has been able to impose his agenda on America using Executive Fiat and the most powerful, albeit unconstitutional, branch of the federal government, the administrative state. He has a “pen and a phone,” remember? However, a bill known as the Midnight Rule Relief Act of 2016 (H.R. 4612) was approved by the House Judiciary Committee and should make its way to the House floor for a vote soon. The purpose of the bill is to stop Obama’s regulatory tyranny by establishing a moratorium on “midnight rules” for the final seven months of his presidency.
Obama and his administration have created 20,642 regulations since he took office in 2009. In 2015, the Obama administration crushed its previous historical record by issuing 2,353 new regulations that equate to $22 billion per year in regulatory costs. Obama has fundamentally transformed America into a nation controlled by nameless, faceless, unelected bureaucrats who tyrannize over individuals, states, and small businesses.
The legislation places restrictions on fed gov agencies tasked with devising and implementing regulations related to Obama’s never-ending Executive Orders. The administrator of the Office of Information and Regulatory Affairs within the Office of Management and Budget must analyze every proposed regulation related to Obama’s “midnight rules” to ensure they will not result in the following:
- An annual effect on the economy of $100,000,000 or more.
- A major increase in costs or prices for consumers, individual industries, Federal, State, or local government agencies, or geographic regions.
- Significant adverse effects on competition, employment, investment, productivity, innovation, or on the ability of United States-based enterprises to compete with foreign-based enterprises in domestic and export markets.
- A significant economic impact on a substantial number of small businesses.
It is undeniable that the legislation is a noble effort by a small number of politicians to stop regulatory tyranny and its destructive effects, but what are the odds it will deter Obama and his army of bureaucrats?
The administrative state is the most powerful branch of the federal government. The fourth branch serves as a tool and weapon for progressive politicians who want to transform America and punish the American people. Obama has spent over seven years ignoring the United States Constitution and bypassing Congress because of his commitment to a political ideology that needs only the administrative state to deliver “utopia.”
It is unlikely that H.R. 4612 is going to hinder Obama from issuing more Executive Orders, but it is worth a shot. However, the most effective way to rein in the Executive Branch is to eliminate Executive Orders. A President would never sign legislation that bans Executive Orders, so this situation might require a constitutional amendment.
